There are situations and conditions that are beyond Tri-Tech’s control. Examples of situations that are beyond Tri-Tech’s control include, but are not limited to:
Delays Caused by Cultural Practices – Cultural practices such as irrigations, cultivations, weeding crews, harvest crews may delay our ability to make applications at the optimum time.
Cultural Practices – Cultural practices, such as, but not limited to, irrigation, cultivation, planting depth, seed placement, fertilizer uniformity, fertilizer efficacy, and variety selection may contribute to less than optimum crop health and quality. Any decrease in crop health can indirectly result in higher sensitivity to pests and disease.
Variety Selection – Crop varieties might fail to perform in certain growing conditions and environments.
Weather Related Crop Damage – Extreme weather conditions such as excessive rain, flooding, wind, freeze, heat can cause direct physical damage to crops as well as a stress to crops that indirectly causes secondary infections and heightened sensitivity to pest and disease.
Weather Related Delays in Application – Weather conditions such as heat, cold, freeze, wind, humidity, and rain can each have an effect on either our ability to complete an application at the planned time or on the efficacy of the actual application.
Delays or Product Selection Due to Harvest Schedules – Harvest schedules and changes in the harvest schedule affect PHI allowances and chemical choice by PCAs and can affect the efficacy of such applications.
Delays due to Bee Notifications – Requirements to comply with bee notifications can affect the timing in which Tri-Tech is able to complete an application.
Delays due to any other compliance requirements – Application methods and timings might be affected by our requirement to comply with safety and legal requirements around sensitive areas such as waterways, environmental habitats, farm crews, public operations, schools, daycare facilities, parks, homes, etc. Timing and allowance of applications might also be delayed to comply with regulatory requirements such as, but not limited to, NOI submittals, resubmittals, and approvals.
Delays in Application or Lesser Product Selection Due to Payment Failure or Budget Requirements – Damage might be incurred if Tri-tech is required to delay application timing or sales due to payment terms.
